1. General

1.1. The drawings, drafts, layouts, and pictures (thereafter “Designs”) presented to the clients, suppliers, and third parties (thereafter “You,” “Your”) are designed and owned by WOWing.PRO (thereafter "the Company," "we," "us," and "our") registered in the Republic of Poland.

1.2. By using any Designs or part of these Designs, You unconditionally agree to and accept to be legally bound by all the terms, conditions, and notices contained in these Terms and Conditions. If You do not agree to these Terms and Conditions, please do not use these Designs.

1.3. In case of any violation of these Terms and Conditions, the Company reserves the right to seek all remedies available under the law for such violations.

1.4. The Company reserves the right to change these Terms and Conditions from time to time at its sole discretion. All changes will be posted on the website www.wowing.pro, and Your use of the Designs after such changes have been posted will constitute Your agreement to the modified Terms and Conditions and all of the changes.

2. Proprietary Rights

2.1. The Designs presented to You, including the information as well as any logos, data sheets, and methodologies are protected by copyright, trademark and other forms of proprietary rights. All rights, title and interest in the Designs are owned by, licensed to or controlled by the Company.

2.2. Except as otherwise provided, the Designs shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission of the Company.

2.3. You may not display, distribute or otherwise use any of the Designs for any commercial purpose unless You receive specific prior written consent from the Company. Use of the Designs for any other purpose will be a violation of the Company’s copyright and other intellectual property rights.

2.4. The Designs are protected by copyright and may not be modified, reproduced or appropriated in any manner without the prior written permission of the Company.

 

3. Indemnification and Liability

3.1. By agreeing to these Terms and Conditions, You agree to indemnify and hold harmless the Company and any individuals affiliated with the Company from and against all claims, liabilities, losses, damages, and expenses (collectively “Losses”) as incurred, jointly or severally (including actions or proceedings in respect thereof) relating to or arising out of Your use of the Designs.

3.2. You also agree that the Company and its affiliates shall not have any liability to You or any person claiming through You, including without limitation its owners, affiliates, security holders or creditors, for any Losses suffered relating to or arising out of Your use of the Designs.

3.3. To the extent that foregoing limitation of liability is prohibited, the Company’s sole obligation of damages is limited to €1.00.

4. Use of Designs

4.1. As a condition of Your use of the Designs, You warrants to us that You will not use the Designs for any purpose that is unlawful or prohibited by these Terms.

4.2. If You print or copy any part of the Designs in breach of these Terms, Your right to use the Designs will cease immediately and you must, at our option, return or destroy any copies of the materials You have made.

5. Governing Law

5.1. These Terms and Conditions shall be governed and construed in accordance with laws of the Republic of Poland and the EU.
